The Miniature Country Club (herein after “Business Owner”)
Agreement Overview
This agreement is between The Miniature Country Club and The Client. It supersedes all prior and simultaneous agreements between the parties. The only way to change this agreement is to do so in writing, and providing the document is agreed in writing between the Business Owner and The Client. This contract for The Miniature Country Club Wedding Hire is effective from the date it is signed by the Business Owner and
the Client.
Hire Period
The hire period will begin on [Insert date of event] and continue for the amount of hours purchased continuously. The start time is liable to change depending on the schedule – this must be confirmed no later than 1 month before the wedding date.
Deposit
The deposit is non - refundable. The deposit is 25 % of your total booking cost. In the event of cancellation, the deposit paid is non - refundable . It shall be liquidated for damages to The Business Owner in the event of cancellation, or breach of contract by The Client. No date is reserved until the deposit is received. The deposit shall be applied towards the total fee pay able, with the full balance to be paid 30 days before the event. If The Client fails to pay the full balance , The Business Owner will not be required to attend said event.
Cancellation
If cancellation occurs within 60 day s of the event date, The Client will be liable for 100% of the total hire fee due to the high probability that The Business Owner will not be able to further book that date. Once a balance is paid, it is non - refundable if The Client cancels or withdraws from the contract for any reason. Cancellation must be made in writing by The Client.
The Business Owner reserves the right to cancel this Contract due to unforeseen circumstances, with the exception of Force Majeure, The Business Owner will provide a full refund of all payments made by The Client.
Force Majeure
If The Business Owner cannot perform this Agreement due to a fire , casualty , strike or other civil disturbances, Acts of God, global pandemics, including but not limited to, road closures, breakdown, severe traffic, fire, terrorism or other causes beyond the control of the parties, then the Parties shall attempt to find a mutually agreeable venue and date for the Agreement to take place. To the extent that a mutually agreeable date cannot be found, The Business Owner agrees to return any moneys paid by the Client, less expenses, but shall have no further liability with respect to the Agreement.
Damage and Client Liability
The Client is responsible for ensuring that all equipment hired from The Business Owner is used in a safe and appropriate manner. The Client agrees to be liable for any loss, damage, or theft of the Equipment during the hire period. The Client understands that their security deposit may not be returned if any loss, damage, or theft of the Equipment occurs during the hire period and further action may be taken if damages are extensive. The Client is therefore advised to obtain event insurance to cover any potential damage or liability that may arise during the use of the Equipment. Anyone under the influence of drink or drugs is prohibited from using the hire equipment. Children under the age of 6 years old cannot use any of the equipment unless fully supervised by an adult. The Client must not use their own personal items to operate the hire equipment provided.
Set Up and Liability
Bookings can only take place on private land with the landowner ’s permission and The Client must provide clear and adequate space for setup. If upon arrival at the venue, The Business Owner cannot operate for any of the reasons stated in this contract, then no refunds are due. The Business Owner requires flat ground to set up on. When not on hard standing flooring, outdoor ground must have short cut grass and not be bare mud/earth, gravel or excessively muddy. The Business Owner reserves the right to refuse set up of any equipment in unsuitable areas and no refund is due.
The Business Owner is not liable for any injury, loss, or damage caused by the use of the Equipment hired or the setup of the equipment hired. This includes any damage due to errant balls, putters etc. from activities it provides. The Business Owner reserves the right to substitute hired equipment with equipment of a similar type and value in the event of damage or loss of pre-booked equipment.
Adverse Weather Conditions
In conditions of extreme high winds (25 mph or more ) or thunder and lightning, The Business Owner reserves the right to cease running all hire equipment for safety reasons. The Business Owner also reserves the right to refuse set up if arrival is during these conditions and may delay until better weather presides. If the hire equipment is due to be set up outside and inclement weather is forecast for the day , The Business Owner is agreeable to offer complimentary set up in an inside area free of charge to avoid having to cease use; however The Client understands that this may mean changes to the lay out and use of some hire items.
Photography and Videography
The Client here by assigns and grants The Business Owner the irrevocable and unrestricted right to use and publish any images or videos taken during the hire period for marketing displays, internet website pages, advertising and any other purpose thought proper by The Business Owner.
Governing Law
This Contract shall be governed by and construed in accordance with the laws of The United Kingdom. If any provision of this agreement is held to be in valid or unenforceable under the law, the validity of this agreement as a whole shall not be affected, and the other provisions of the agreement shall remain in full force and effect. This contract has been freely negotiated and shall be recognised as the entirety of the agreement. Only those changes or modifications specifically placed in writing, attached, dated and signed by The Client and The Business Owner at the time of acceptance of this contract shall be recognised as amendments to this contract.
